That institution, gentlemen, is a court. It can be the Supreme Court of the United States or the humblest J.P. court in the land, or this honourable court which you serve. Our courts have their faults, as does any human institution, but in this country our courts are the great levellers, and in our courts all men are created equal.

We know all men are not created equal in the sense some people would have us believe- some people are smarter than others, some people have more opportunity because they're born with it, some men make more money than others, some ladies make better cakes than others- some people are born gifted beyond the normal scope of men.

A lot of you young people, even though you go through college, you still don't understand that courtroom. That courtroom is the court of the kings and lords of the world. We as human beings can invoke the ground here called the United States of America. And the reason our system has perpetuated in such a way is because all the powers of Europe and England and monarchies and all those big people; we have come over here and started another world where each man in the United States has that power because he has that courtroom. That courtroom belongs to every human being in the United States. And if you take that courtroom away from one human being, you're taking that courtroom away from all human beings. Then what follows is you got kings and queens of yesterday – they're gonna come and play croquet with your heads. They're gonna take your courtrooms. They're gonna take your money and they're gonna take your country. They're gonna take your resources. They're gonna rip you off in every way you can think of because you didn't give your own children the benefit of the courtroom that your fathers fought in battles and died for.

A court is the most depressing place on earth. Wherever there is a throne, one may observe in rich detail every folly and wickedness of which man is capable, enameled with manners and gilded with hypocrisy.

Unlike the unfortunate practice or custom in Washington and in much of the country, the court is a model of civility. It's a wonderful place. Though there have been many contentious issues to come before the court during these initial years of my tenure, I have yet to hear the first unkind words exchanged among my colleagues. And quite frankly, I think that such civility is the sine qua non of conducting the affairs of the court and the business of the country.

It is one of the essential qualities of a Court of justice, that its proceedings should be public, and that all parties who may be desirous of hearing what is going on, if there be room in the place for that purpose,—provided they do not interrupt the proceedings, and provided there is no specific reason why they should be removed,—have a right to be present for the purpose of hearing what is going on.

The Court is perhaps one of the last citadels of jealously preserved individualism. For the most part, we function as nine, small independent law firms.

I’m no idealist to believe firmly in the integrity of our courts and in the jury system — that is no ideal to me, it is a living, working reality. Gentlemen, a court is no better than each man of you sitting before me on this jury. A court is only as sound as its jury, and a jury is only as sound as the men who make it up.

I'm ready for my day in court. Appearance in court does not translate into one being necessarily guilty. Courts were established for the sole purpose of determining the guilt or innocence of individuals.

The court has built a great deal of prestige, and I think is generally quite well thought of as a public institution in the country. It is always possible for the court to overreach its proper bounds and perhaps declare a lot of laws unconstitutional and frustrate the will of the majority in a way that it ought not be frustrated. In that sense, it poses a danger, but not the same sort of perhaps very active danger that a run-away Congress or runaway executive would.

The role of the court is to apply law to the facts of the case before it … not to legislate, not to arrogate to itself the executive power, not to hand down advisory opinion on the issues of the day.

Courts are the mere instruments of the law, and can will nothing. When they are said to exercise a discretion, it is a mere legal discretion, a discretion to be exercised in discerning the course prescribed by law; and, when that is discerned, it is the duty of the Court to follow it. Judicial power is never exericised for the purpose of giving effect to the will of the Judge; always for the purpose of giving effect to the will of the Legislature; or, in other words, to the will of the law.
