Untold American lives have been ruined by the presidency of Donald Trump. The rule of law is imperiled, our unity has been shattered, the service sector has been obliterated, and major cities are suffering. Black Americans, who have endured half a millennium of wickedness and brutality, now face more injustice and death.

Donald Trump is the steadfast leader our nation needs. He has spoken passionately to me of his belief in our American system of justice, and he speaks to the values that are at the foundation of our social contract. Throughout his campaign, and over many years before, he has consistently and constantly raised his voice — not only in defense of the character of the American police officer, but the need for all people to feel they are being treated fairly and respectfully by law enforcement.You see, Donald Trump understands that what can make our nation safe again is a recommitment to a system of justice in which no government official, not even those who have fought their way to the marble and granite halls of Washington; no private citizen, not even Hillary Clinton; and no group of people, despite the fervor with which they press forward their grievances, can claim privilege above the law. It cannot happen in the United States.

[T]he Trump presidency is unlike anything that came before, a presidency built on open public contempt for Constitutional principles.

Trump was systemically attacking the courts, the press, and Congress — a vintage move by an autocrat to dismantle institutions constricting his power.

Violent crime was up under Donald Trump. And that’s not even counting the crimes he committed.

More important, he [Trump] has governed in defiance—and in ignorance—of the American Constitution, notably declaring, well into his third year in office, that he had "total” authority over the states. His administration is not merely corrupt, it is also hostile to checks, balances, and the rule of law. He has built a proto-authoritarian personality cult, firing or sidelining officials who have contradicted him with facts and evidence—with tragic consequences for public health and the economy. ... Trump has attacked America’s military, calling his generals "a bunch of dopes and babies," and America's intelligence services and law-enforcement officers, whom he has denigrated as the "deep state" and whose advice he has ignored.

Donald Trump is frankly dangerous.

Donald Trump has built his campaign on prejudice and paranoia. He’s taking hate groups mainstream and helping a radical fringe take over one of America’s two major political parties. His disregard for the values that make our country great is profoundly dangerous. In just the past week, under the guise of "outreach" to African Americans, Trump has stood up in front of largely white audiences and described black communities in insulting and ignorant terms.

Here is the worst part: Donald Trump knows that millions of Americans who supported him would stand up and defend our nation were it threatened. They would put their lives and freedom at stake to protect her. And he is preying on their patriotism. He is preying on their sense of justice. And on January 6th, Donald Trump turned their love of country into a weapon against our Capitol and our Constitution. He has purposely created the false impression that America is threatened by a foreign force controlling voting machines, or that a wave of tens of millions of false ballots were secretly injected into our election system, or that ballot workers have secret thumb drives and are stealing elections with them. All complete nonsense. We must remember that we cannot abandon the truth and remain a free nation.

As we saw on Jan. 6, when elected leaders defy the law, they invite their followers to do the same. Chaos reigns, the courts become powerless, and mob rule (directed by an authoritarian leader) prevails. When [Donald] Trump lambastes judges and prosecutors and promises to "weaponize" the Justice Department, judges must maintain a zero-tolerance policy for officials' (and former officials') defiance of laws and court orders and ignore their claims of persecution. Judges should continue to denounce the contempt for courts, the law and truth Republicans routinely display.
If courts do not mete out severe consequences for willful disregard of the law and attacks on the legitimacy of the courts, Trump will succeed in ripping up the foundation of our democracy. Judges simply must hold the line.

We are living in an unprecedented moment in American history. Donald Trump is not only a pathological liar, has not only helped wage an insurrection … to prevent President Biden from taking office. Not only is denying American democracy — moving against the American democracy. So I think at this moment … we have got to bring the progressive community together to say, you know what, we're gonna fight for a progressive agenda. But we cannot have four more years of Donald Trump in the White House.

Donald Trump is the most dangerous president in the modern history of our country and he must be defeated. Tragically, we have a president today who is a pathological liar and who is running a corrupt administration. He clearly does not understand the Constitution of the United States and thinks that he is a president who is above the law. In my view, he is a racist, a sexist, a homophobe, a xenophobe and a religious bigot, and he must be defeated, and I will do everything in my power to make that happen.

Donald Trump is not only the wrong many for the presidency, he is unfit to lead the country. Trump was far worse than Richard Nixon, the provably criminal president. As I have pointed out, Trump governed by fear and rage. And indifference to the public and national interest. Trump was the most reckless and impulsive president in American history and is demonstrating the very same character as a presidential candidate in 2024.

Today’s decision to grant former Presidents criminal immunity reshapes the institution of the Presidency. It makes a mockery of the principle, foundational to our Constitution and system of Government, that no man is above the law. Relying on little more than its own misguided wisdom about the need for “bold and unhesitating action” by the President, ante, at 3, 13, the Court gives former President Trump all the immunity he asked for and more. Because our Constitution does not shield a former President from answering for criminal and treasonous acts, I dissent.
