After a victim has reported a crime to the police, many people believe that the decision whether or not to charge the suspect with a crime, and then prosecute the suspect, is the prerogative of the victim. News media often contribute to this misconception in stories about rape victims by reporting that a victim 'declined to press charges.' In fact, the criminal justice system gives victims no direct say in the matter. It's the police, for the most part, who decide whether a suspect should be arrested, and prosecutors who ultimately determine whether a conviction should be pursued.

"Statistically, the odds that any given rape was committed by a serial offender are around 90 percent," Lisak said. "The research is clear on this. The foremost issue for police and prosecutors should be that you have a predator out there. By reporting this rape, the victim is giving you an opportunity to put this guy away. If you decline to pursue the case because the victim was drunk, or had a history of promiscuity, or whatever, the offender is almost certainly going to keep raping other women. We need cops and prosecutors who get it that 'nice guys' like Frank are serious criminals."

As one civil-liberties lawyer, who is concerned about the sometimes vigilante attitude toward accused rapists, puts it: "Some people regard rape as so heinous an offense that they would not even regard innocence as a defense."

I see the sexual impulse as egotistical and dominating, and therefore I have no problem understanding rape. Women have to understand this correctly and they'll protect themselves better. If a real rape occurs, it's got to go to the police. The business of having a campus grievance committee decide whether or not a rape is committed is an outrageous infringement of civil liberties. Today, on an Ivy League campus, if a guy tells a girl she's got great tits, she can charge him with sexual harassment. Chickenshit stuff. Is this what strong women do?

The woman who is not pursued sets up the doctrine that pursuit is offensive to her sex, and wants to make it a felony. No genuinely attractive woman has any such desire. She likes masculine admiration, however violently expressed, and is quite able to take care of herself. More, she is well aware that very few men are bold enough to offer it without a plain invitation, and this awareness makes her extremely cynical of all women who complain of being harassed, beset, storied, and seduced. All the more intelligent women that I know, indeed, are unanimously of the opinion that no girl in her right senses has ever been actually seduced since the world began;

I guess it's ok to rape white women then?

Police and prosecutors are morally and professionally obligated to make every effort to identify specious rape reports, safeguard the civil rights of rape suspects, and prevent the falsely accused from being convicted. At the same time, however, police and prosecutors are obligated to do everything in their power to identify individuals who have committed rape and ensure that the guilty are brought to justice. These two objectives are not mutually exclusive. A meticulous, expertly conducted investigation that begins by believing the victim is an essential part of prosecuting and, ultimately, convicting those who are guilty of rape. It also happens to be the best way to exonerate those who have been falsely accused. Rape victims provide police with more information — and better information — when detectives interview them from a position of trust rather than one of suspicion.

That's what law school allowed me to have - was time to actually read abolitionist literature - you know, read "Abolition Democracy" by Angela Davis, read her other book "Are Prisons Obsolete?" - the more time I had to study, you know, works from, like, Naomi Murakawa. I mean, I just had so much time to start learning the history of police, the function of police, how this word crime is a social construct, how there's so much sexual violence in this world - in this country, in particular - and it's not all reducible to what to do with a rapist - right? - because most people who commit sexual violence will never see a day in prison. And so police and prisons are currently inadequate responses to the sexual violence that we have right now. They're currently inadequate responses to the homicides that we have right now - right? - the harms of our nightmares. You look across the country - the police clearance rate for murders is something like 40-50%, which means that 40-50% of people accused of murdering someone are just arrested and charged - not even convicted, right?

The harsh fact is there are not sufficient safeguards in place to identify and discipline police officers who abuse women, yet we are expected to trust the very same men to investigate crimes against the most vulnerable female victims. If women in this country are ever to feel safe – and it is something that should be ours by right – we urgently need a public inquiry into institutional misogyny within the police.

A false accusation of rape has the side effect of inducing skepticism, causing genuine accusations to be taken less seriously. You are also harming the true victims.
