This is not the “rule of law”...it is the “rule of law enforcement.”

Whenever you are about to be oppressed, you have a right to resist oppression: whenever you conceive yourself to be oppressed, conceive yourself to have a right to make resistance, and act accordingly. In proportion as a law of any kind—any act of power, supreme or subordinate, legislative, administrative, or judicial, is unpleasant to a man, especially if, in consideration of such its unpleasantness, his opinion is, that such act of power ought not to have been exercised, he of course looks upon it as oppression: as often as anything of this sort happens to a man—as often as anything happens to a man to inflame his passions,—this article, for fear his passions should not be sufficiently inflamed of themselves, sets itself to work to blow the flame, and urges him to resistance. Submit not to any decree or other act of power, of the justice of which you are not yourself perfectly convinced. If a constable call upon you to serve in the militia, shoot the constable and not the enemy;—if the commander of a press-gang trouble you, push him into the sea—if a bailiff, throw him out of the window. If a judge sentence you to be imprisoned or put to death, have a dagger ready, and take a stroke first at the judge.

An unjust law is itself a species of violence. Arrest for its breach is more so. Now the law of nonviolence says that violence should be resisted not by counter-violence but by nonviolence. This I do by breaking the law and by peacefully submitting to arrest and imprisonment.

When law and force keep a man within the bounds of justice, they impose nothing upon him but a mere negation. They only oblige him to abstain from doing harm. They violate neither his personality, his liberty, nor his property. They only guard the personality, the liberty, the property of others. They hold themselves on the defensive; they defend the equal right of all.

...be prepared first to look at the evidence and to recognize how little the widespread use of prison reduces our crime or deals effectively with many of the individuals concerned. [The rule of law does not mean] our own pet prejudices. It means, in a democratic society, the law as passed by an elected Parliament and applied by impartial courts. You cannot have a rule of law while dismissing with disparagement Parliament, the courts and those who practise in them. That is not the rule of law. It is exactly what the pressure groups you complain about seek to achieve by demonstration.

You don’t question the right of the government to kill, to confiscate and imprison. If a private person should be guilty of the things the government is doing all the time, you’d brand him a murderer, thief and scoundrel. But as long as the violence committed is “lawful,” you approve of it and submit to it. So it is not really violence that you object to, but to people using violence “unlawfully.

To this I answer: That force is to be opposed to nothing, but to unjust and unlawful force. Whoever makes any opposition in any other case, draws on himself a just condemnation, both from God and man...

At what point, then, should one resist? When one's belt is taken away? When one is ordered to face into a corner? When one crosses the threshold of one's home? An arrest consists of a series of incidental irrelevancies, of a multitude of things that do not matter, and there seems no point in arguing about one of them individually...and yet all these incidental irrelevancies taken together implacably constitute the arrest.

The doctrine of the Rule of Law limits the powers of government and helps to prevent dictatorship as well as to protect the rights of the people.

Dear all, the rule of law is not something you can declare, decree even in the Constitution. It is an attribute of some form of social organization. The fundamental element in this type of organization is with the balance of power. If a certain social force enjoys a great superiority, it will always instrumentally dominate the law. It will always bring it under its own control. There is no other way. It is the balance that is needed.

In order to have a legal arrest, you need probable cause to believe that the person committed a crime. And these snatches, by unidentified federal officials in unmarked vehicles, snatching peaceful protesters off the streets, transporting them to unknown locations without informing them of why they’re being arrested, and later releasing them with no record of their arrest, violates the law. And this “proactive” arrest that the Department of Homeland Security is intending to carry out, violates the Fourth Amendment, which requires that, as I said, an arrest be supported by probable cause.... There is nothing in the law that allows “proactive arrest.”

When you come in conflict with the Law, the Law will catch up with you. Whoever is not following the Law, the Law definitely will catch up with them.

Certain other societies may respect the rule of force — we respect the rule of law.
